Musharraf's Crimes:
1. Violation of the
Constitution:
A) He acted against the Constitution of Pakistan in 1999, overthrew an
elected government and dissolved assemblies thus being liable to be tried
for high treason under Article 6 of the Constitution, which says that:
High treason.
(1) Any person who abrogates or attempts or conspires to abrogate, subverts
or attempts or conspires to subvert the Constitution by use of force or show
of force or by other unconstitutional means shall be guilty of high treason.
(2) Any person aiding or abetting the acts mentioned in clause (1) shall
likewise be guilty of high treason.
(3) Majlis-e-Shoora (Parliament) shall by law provide for the punishment of
persons found guilty of high treason.
B) Dictator Musharraf violated the Constitution again on 3rd November, 2007
when he imposed emergency, which has been termed as mini-Martial Law and
destroyed judiciary in the country. He is on record to have said that he
acted extra-constitutionally on 3rd November, 2007.
2. Violation of oath:
He violated the oath prescribed for the members of the armed forces under
Article 244 of the Constitution. It says:
(In the name of Allah, the most Beneficent, the most Merciful.)
I, ____________, do solemnly swear that I will bear true faith and
allegiance to Pakistan and uphold the Constitution of the Islamic Republic
of Pakistan which embodies the will of the people, that I will not engage
myself in any political activities whatsoever and that I will honestly and
faithfully serve Pakistan in the Pakistan Army (or Navy or Air Force) as
required by and under the law.
May Allah Almighty help and guide me (Ameen).
3. Military operation in Balochistan, murder of Akbar Bugti:
He launched a military operation in Balochistan, committed atrocities
against the citizens, threatened the people with dire consequences and is
responsible for the assassination of veteran Baloch leader Akbar Bugti,
Balach Mari and several others. He should be charged for their murder and
the crimes he has committed against the people of Balochistan.
4. Assassination of Benazir Bhutto:
He is a main suspect in the assassination of popular leader and twice
elected prime minister of Pakistan Benazir Bhutto. The slain leader in
communication to a US lobbyist and a newsman had said that in case of her
assassination, Musharraf should be held responsible. A recent published book
has revealed that Musharraf had warned Benazir Bhutto that her safety
depended on her relationship with him. Musharraf should be booked as a main
suspect in the assassination of Benazir Bhutto.
5. Illegal referendum, formation of king's party and manipulations in
government making:
He held an illegal and unconstitutional referendum to perpetuate his rule
and manipulated 2002 elections and used intelligence agencies to put
together a "king's party" and manufacture governments in the provinces and
the center denying the real representatives of the people to form
governments. That is a serious crime against democracy and the Constitution.
6. Handing over Sindh to terrorist organization MQM:
However rigged the 2002 elections were, the PPP had still emerged as the
largest single party in Sindh. He denied the right of the PPP to form a
government in Sindh and instead using intelligence agencies imposed the
terrorist organization MQM on the province. The terrorist organization MQM
usurped the rights of the majority and established hegemony in almost all
sectors of life and economy.
7. Enforced disappearances:
Musharraf used intelligence agencies for nefarious designs and arrested,
confined and imprisoned a large number of people without any charges and
without their kith and kin or the courts of law knowing their whereabouts.
Many of such disappeared people later surfaced in the custody of foreign
governments without any legal extradition procedures. It is believed that he
and his relations and friends have collected large sums of bounty for
illegal extraditions. He must face charges on this account in a court of
law.
8. Attack on judiciary:
He illegally deposed the Chief Justice of Pakistan, Mr. Justice Iftikhar
Muhammad Choudhry on 9th March 2007, subjected him to torture and unlawfully
confined him and his family including small children disallowing anyone to
see him or his children going to schools. The Supreme Court on 20th July
2007 in a landmark decision overthrew his illegal orders and reinstated the
Chief Justice.
9. Another attack on judiciary:
He attacked the judiciary again on 3rd November, 2007, enforced emergency, a
Martial Law in real terms, acted against the Constitution and deposed 60
superior court judges in one go imprisoning most of them.
10: May 12 massacre and other bloodshed:
He used his collaborators MQM to launch a reign of terror in Karachi on May
12th, 2007 to stop the Chief Justice of Pakistan, Mr. Justice Iftikhar
Muhammad Choudhry from visiting the provincial metropolis. The MQM
terrorists blocked major roads, brought the life to standstill and using
heavy weapons killed and injured scores of people. Dictator Musharraf
celebrated the massacre in an Islamabad meeting and called it a â show of
force of his collaborators MQM and a warning for anyone who dared to
trespass the territory of the rogue Karachi based terrorists.
He and his staunch ally MQM are also said to be responsible for October 18
attack on Benazir Bhutto's homecoming rally in Karachi that killed and
injured scores of people. His collaborators are also responsible for April 9
massacre in Karachi where besides other killings and acts of arson a number
of lawyers and their visitors/clients were burned alive by his allied MQM
terrorists.
11. NFC Award:
He violated the Article 160 of the Constitution and failed to constitute the
National Finance Commission thus denied Sindh and other provinces their due
share in the revenues, taxes, grants and other financial resources. The
relevant Clause 160 of the Constitution says:
13. National Finance Commission.
(1) Within six months of the commencing day and thereafter at intervals not
exceeding five years, the President shall constitute a National Finance
Commission consisting of the Minister of Finance of the Federal Government,
the Ministers of Finance of the Provincial Governments, and such other
persons as may be appointed by the President after consultation with the
Governors of the Provinces. (2) It shall be the duty of the National Finance
Commission to make recommendations to the President as to-
(a) the distribution between the Federation and the Provinces of the net
proceeds of the taxes mentioned in clause (3);
(b) the making of grants-in-aid by the Federal Government to the Provincial
Governments;
(c) the exercise by the Federal Government and the Provincial Governments of
the borrowing powers conferred by the Constitution; and
(d) any other matter relating to finance referred to the Commission by the
President.
13. Illegal election as president:
He had taken over the power illegally and perpetuated his rule through an
unconstitutional referendum and a so-called vote of confidence from the
Electoral College. All his acts as well as his election to presidency in
2007 was in clear violation of the Constitution. The Clause 43 says:
43. Conditions of President's office.
(1) The President shall not hold any office of profit in the service of
Pakistan or occupy any other position carrying the right to remuneration for
the rendering of services. …â€
At that time he was still Chief of Army Staff.
14. Murder of Hamad Raza:
Musharraf is a main suspect in the murder of the Additional Registrar of the
Supreme Court of Pakistan Hamad Raza who was killed in mysterious conditions
soon after the illegal action against the Chief Justice of Supreme Court of
Pakistan, Mr. Justice Iftikhar Muhammad Choudhry. He is alleged to have been
killed as he refused to cooperate in providing evidence against the Chief
Justice.
15. Absolving a rapist:
Musharraf misused his illegal authority and acted as a judge to absolve a
military official who was accused of raping a lady doctor in Sui,
Balochistan without allowing any legal process to take place. He used
government power to force the victim leave the country. On a visit to USA,
he shamelessly said that women in Pakistan invite rape to seek a visa to
western countries.
16. Lal Masjid:
He is responsible for the gross mishandling of the Lal Masjid Islamabad
issue that resulted in the murder of a large number of students, teachers
and others including women and children.
17. War against own people in Pakhtoon areas:
He is responsible for the mishandling of the situation in the Pakhtoon
tribal areas, the worsening of situation there and the murder and mayhem and
migration of population on a large scale.
18. Murder of a Lawyer Mr. Iqbal:
He is a main suspect in the murder of a lawyer Mr. Iqbal who had publicly
said that he would prove in a court of law beyond any doubt that Musharraf
plane hijack in October 1999 was a drama to frame Prime Minister Nawaz
Sharif. He is accused of using MQM terrorists to kill the outspoken lawyer.
19. Attacks on lawyers and media:
He unleashed a reign of terror against lawyers and media during the lawyers
struggle for the restoration of the Chief Justice of Pakistan. He put behind
bars some lawyers and journalists, threatened several others with dire
consequences and closed some media channels that tried to be objective.
20. Steel Mills case:
He is responsible for the major scandal of the Pakistan Steel Mills give
away. He, his hand-picked Prime Minister Shaukat Aziz and others involved
in the case must stand trial.
There are several other charges of corruption, misconduct, atrocities,
murder, highhandedness, misuse of authority, aiding and abetting terrorists,
etc against dictator Musharraf and his collaborators. It is must that he and
his accomplices face the law instead of given safe passage and indemnity. It
would be another serious crime against the people and the country if he is
not brought to the book.
21. Imposition of Emergency
He imposed martial law second
time in Pakistan on November 3, 2007. He called it emergency plus. In this
mini martial law he held constitution in abeyance, illegally incorporated an
article in the constitution to protect his illegal acts.
22. Illegal NRO
He illegally issued NRO in which
he gave immunity to hundreds of criminals who had committed various crimes
of fraud, bribery, tax evasion, and financial corruption.

Musharraf Trial Project
General Musharraf illegally took over Pakistan on October 12, 1999. After
illegally taking over Pakistan, he committed serious crimes against the
constitution, the state and the people of Pakistan. He kidnapped, tortured,
jailed, exiled and killed a large number of his opponents during 9 years of
his tyrannical rule. There are still hundreds of missing Pakistanis whose
whereabouts are not known to anyone in Pakistan. Some mass graves have been
discovered in Swat area. These may be the mass graves of missing Pakistanis,
the victims of Musharraf's criminal acts.
PPP govt. does not seem interested in trial of Musharraf for his
crimes. PPP govt. is conniving with International forces who were served by
Retired general Musharraf and who now want to protect him.
Through this website, we will put all our resources together to see
Musharraf tried for his crimes against the constitution, the state and the
people of Pakistan.
Musharraf did not only commit crimes against the constitution, the state
and the people of Pakistan he also committed crimes against humanity by
joining illegal military expeditions around the globe.
We appeal all Human Rights organizations to chase this criminal at large
and push him to the prison cell where he spends rest of his life and pays
for the crimes he committed against humanity.

International) - Issuing a 14-point charge sheet against former
[Pakistan Army Chief General (R)] Pervez Musharraf on the eve of
anniversary of October 12,
1999 coup, the PML-N [Pakistan Muslim League] on Monday
demanded transformation of his resignation of August 18, 2008 into
dismissal and revoking his entire fringe benefits, facilitations and
immunities, which he is currently enjoying as a retired [Pakistan]
Government official (Army Chief).
The [PML-N] charge sheet says that General (R) Musharraf
illegally took over Pakistan on October 12, 1999 and after taking over
Pakistan he committed enormous serious crimes against the Constitution,
the state and the people of Pakistan. "The charge-sheet is for the [PPP]
president, [PPP] prime minister, Parliament and the Supreme Court of
Pakistan to take actions," the PML-N spokesman Parvez Rashid said.
The [PML-N] charge sheet is also being considered as
response to Pervez Musharraf's outburst against Nawaz Sharif while
sitting in London [UK]. The PML-N spokesman said the release of charge
sheet is to bring a national culprit into the court of law and try him
under Article 6 of the Constitution of Pakistan. "His rule brought
innumerable miseries to the people of Pakistan. He has been the most
corrupted, callous, immoral and ruthless ruler of the country, and
people were subservient to his whims and wishes. It is high time, he be
tried; otherwise, Pakistan would never be able to get rid of imprudent,
self-righteous Napoleonic idiocy of military regimes," the charge sheet
said.
The PML-N on the basis of its charge sheet has also
demanded that Musharraf should be brought back to Pakistan through the
InterPol [International Police -

] for making sure his production before the court of law to try him for
the misdeeds as elucidated above.
The PML-N also demanded invocation and execution of Article
6 of the Constitution of Pakistan for the purpose to penalize him on his
crimes against the Constitution of Pakistan, the state of Pakistan and
the people of Pakistan; formation of a commission on the Kargil so that
those responsible for the misadventure could be brought to book;
formation of an independent commission to probe into the situation which
had lead to death of more than 48 people. The PML-N also demanded
penalization of General (retd.) Musharraf for violation of human rights
under the NRO [National Robbers Ordinance], abductions, massacres,
disappeared people and putting curbs on the [Pakistani] media.
The [PML-N] charge sheet carries following charges against
Pervez
Musharraf:
1. Imposition of Martial Law:
General (retd.) Pervez Musharraf imposed illegal Army
Martial Law in the country twice, subverted the Constitution and
violated the oath taken by him as an Army Chief. He kept the elected
Prime Minister Muhammad Nawaz Sharif behind bars in the Attock Fort,
illegally detained judges of the superior courts (Supreme Court and High
Courts) with their family members and imposed military dictatorship at
gunpoint. In this way, he acted against the Constitution of Pakistan in
[October] 1999, overthrew an elected PML-N government and dissolved
assemblies thus being liable to be tried for High Treason under Article
6 of the Constitution. Musharraf violated the Constitution again on 3rd
November 2007 when he imposed Emergency, which has been termed as
mini-Martial Law and destroyed judiciary in the country. He is on record
to have said that he acted extra-constitutionally on 3rd November 2007.
2. Kargil Misadventure:
He planned and undertook the Kargil misadventure,
concealing it from the elected PML-N government, sacrificing some 800
Pakistan Army officers and men of the Army in the process.
3. Misuse of Army for his Own Cause:
He used Pakistan Army as his personal force, tried to
corrupt it and gave promotion to his blue-eyed officers. He used the
Army for different unconstitutional and illegal actions meant to prolong
his rule, badly affecting the credibility of the national institution.
4. Declaration of War Against the People of Pakistan:
He pushed the Army into an undeclared war against its own
people without seeking approval from the PML-N prime minister, PML-N
Cabinet and the Parliament, which has so far resulted in the killing of
over 1,000 Army men. Suicide bombings in reaction have also claimed
lives of a large number of Pakistanis.
5. Blackmailing Through NAB:
He blackmailed and subjected different people to torture
and abuse, using the National Accountability Bureau (NAB) to form a
PML-Q political party. He indulged the Pakistan Army in the illegal act
of getting involved in the politics, which is again an unpardonable
crime.
6. Murder of Akbar Bugti:
He got Akbar Bugti killed in cold blood to implement the
threat he had earlier hurled on him and congratulated the people
involved in the killing after the act.
7. Disappearance of People and Conspiracies in Balochistan:
Thousands of Baloch political workers were made victim of
enforced disappearance, with their family members still unaware of their
whereabouts. Various Baloch leaders, including Akhtar Mengal, were
implicated in false cases and jailed.
8. Killings in Lal Masjid:
The Lal Masjid (Red Mosque of Islamabad) was attacked on
the pressure of external powers (the Israeli-Zionist Bush-Cheney Junta
of War Criminals), resulting in the death of hundreds of innocent boys
and girls.
9. Abduction of People:
He abducted, handed over and sold Pakistani citizens. The
numbers are in thousands. Nobody till today knows where these people
are. For this crime only he should be hanged several times. Over 650
people of Pakistani and Afghan origin illegally picked up from different
parts of the country were handed over to the United States in return for
dollars. This he (Traitor Musharraf) admitted in his book.
10. Cronyism, Nepotism, Corruption and Favoritism:
He set new examples of cronyism, nepotism, corruption and
favoritism.
During his eight years in power, General Musharraf made
billions of rupees as his close associates got massive contracts from
NHA, OGDC, PIA, besides earning billions of rupees in defense deals.
11. Attacks on Judiciary:
He illegally deposed the Chief Justice of Pakistan, Justice
Iftikhar Muhammad Chaudhry, on 9th March 2007, subjected him to torture
and unlawfully confined him and his family, including small children,
disallowing anyone to see him or his children, who were not allowed to

12. May 12 and October 18, 2007 Massacres and Other
Bloodshed:
Circumstances hint that General (retd.) Musharraf had
played inevitable role in the ruthless killings of 48 precious lives and
burning of lawyers of Karachi on May 12 while the deposed Chief Justice
of Pakistan, Iftikhar Muhammad Chaudhry, was supposed to address the
lawyers' community in the same city. Similarly, more than 150 human
lives were killed on the day when the ex-PPP leader, Benazir Bhutto,
returned to the country after her exile of 9 years on October 18, 2007.
He never bothered to hold any inquiry to probe into the happenings and
bring about the truth. The people of Pakistan want to know as to who was
behind these incidents.
13. Promulgation of NRO:
On October 05, 2007, Musharraf issued the worst ever law in
the history of civilized world. NRO (National Robbers Ordinance) is in
direct conflict with the spirit of the Constitution. NRO was for the
protection of corruption, which nullified such cases, which only the
courts were competent to decide.
14. Unconstitutional and illegal Candidature and Election
as the President of Pakistan:
First he took over the country illegally by ousting the
elected (PML-
N) government and perpetuated his rule through an
unconstitutional referendum and a so-called vote of confidence from the
Electoral College. Later on, he being an Army Chief contested the
presidential election in 2007, which was again violation of the
Constitution of Pakistan as well as his oath of an Army Chief. All his
acts as well as his election to presidency in 2007 were in clear
violation of the Constitution. This again made him an offender under the
Article 6 and
43 of the Constitution, and a violator of his oath as the
Army Chief under Article 244 of the Constitution.
The PML-N has always opposed the idea of giving a safe exit
to Musharraf and it does believe that it is still the best and a fit
case for trial under Article 6 of the Constitution. Reconciliation
policy of the (PPP) government extended to General (retd.) Musharraf was
meaningless as it was nothing but a folly to encourage such national
criminals to keep on playing with the fortunes of the poor people of
Pakistan.

PPP Government's Constitutional Responsibility |

| It is PPP government's constitutional responsibility to try general
Musharraf under the article 6 of the constitution of Pakistan.
The failure to do so implicates PPP government in general
Musharraf's crimes which fall in the jurisdiction of article 6 of
the constitution of Pakistan.
It is the responsibility of the President, Prime Minister and
those who represent them including Law Minister, Interior Minister,
Chairman of Senate, and Speaker of the National Assembly to initiate
the trial.
If they shy away from their constitutional responsibility, they
may be held responsible for not doing so by future governments or
other law enforcement authorities. |

October 12, 2009: A large crowd of people demonstrated
in Faisal Abad demanded Musharraf's trial. They carried Musharraf's
effigy through the streets of Faisal Abad and hanged it at town's
central point the Ghanta Ghar.
Akbar Bugti Murder Case
Registered Against General Musharraf
October 13,
2009:(Pakistan Weekly) Dera Bugti City Police Station has formally registered Akbar Bugti
murder case against General Musharraf, Shaukat Aziz, Jam Yousaf, Aftab
Sherpao, Shoab Nosherwani and Awais Ghani. While reporting the
registration of the case, GEO reporter reported the murder case against
general Musharraf and other accomplices has been registered at Dera
Bugti City Police Station after Balochistan High Court ordered the
police station to register the case.
Akbar
Bugti’s son Jamil Akbar Bugti filed petition in Balochistan High Court
to order Dera Bugti City Police Station to register the case against
general Musharraf and other four accomplices.
In a
decision, Supreme Court of Balochistan ordered the Dera Bugti City
Police Station to register the case. Today, Jamil Akbar Bugti’s attorney
Sohail Ahmed produced Balochistan High Court’s orders at Dera Bugti City
Police Station. In compliance with Balochistan High Court’s orders, Dera
Bugti City Police Station filed murder case against general Musharraf,
Shaukat Aziz, Jam Yousaf, Aftab Sherpao, Shoab Nosherwani and Awais
Ghani.
This is a
landmark development in initiation of cases against general Musharraf
who illegally took over Pakistan on October 12, 1999 and then governed
it till his ouster on August 18, 2008 through mafia style operations.
We at
Musharraf Trial Project consider it a positive development to drive the
former dictator to the trial stand to face the law for his crimes. This
case will encourage the loved ones of other victims of general Musharraf
to seek legal recourse for the atrocities committed by him against them.
It will also increase pressure on government to activate article 6
against general Musharraf to try him for high treason charges and other
crimes that he committed against the constitution, the state and the
people of Pakistan.

Nawaz-Zardari Discuss Musharraf's Trial |

| October 25: Pakistan Weekly. PML (N) Quaid Nawaz Sharif and
President Zardari discussed possibility of Musharraf's trial. Mian
Nawaz Sharif demanded the government should initiate trial against
Musharraf. President Zardari said his government cannot afford to
open to many fronts at this point. Therefore, Musharraf's trial has
to wait for some more suitable time. |
